FOX 4 News - Attorneys for BISD are expected to ask a judge to cancel the November election.
It comes after an appeals court ruled Thursday that a November election would violate state law because it would not be a joint election with the city, county or state.
That election only had one contested race. The appeals court ruled that when BISD hold an election it should use a plan voters already approved, which call for five single member districts and two at large seats.
Early voting is set to begin Monday, so both sides are seeking a quick decision. On Friday night, attorney Michael Getz released a statement that if Judge Floyd cancels the election, then Getz will seek a court order to force the district to hold an election under a 5-2 plan as quickly as possible.
